Howard K. Stern Asks Judge Robert Perry To Throw Out Charges

A jury of 12 found Anna Nicole Smith’s live in attorney Howard K. Stern guilty on two felony counts of conspiracy on October 28th, 2010.

We the Jury in the above-entitled action, find the Defendant, Howard K.Stern, guilty of the crime of CONSPIRACY TO COMMIT A CRIME, during the period September 11, 2006 to February 8, 2007 in violation of Penal Code Section 182(a)(1), a felony as charged in Count 1 of the Information

We further find the defendant Howard K. Stern conspired to commit the crime of obtaining a controlled substance by fraud, deceit or misrepresentation or concealment of a material fact in violation of Health and Safety Code 11173(a)

We further find the defendant Howard K. Stern conspired to commit the crime of unlawfully giving a false name in a prescription for a controlled substance in violation of Health and Safety Code 11174

We the Jury in the above-entitled action, find the Defendant, Howard K.Stern, guilty of the crime of CONSPIRACY TO COMMIT A CRIME, during the period June 5, 2004 to September 10, 2006 in violation of Penal Code Section 182(a)(1), a felony as charged in Count 3 of the Information.

We further find the defendant Howard K. Stern conspired to commit the crime of obtaining a controlled substance by fraud, deceit or misrepresentation or concealment of a material fact in violation of Health and Safety Code 11173(a)

We further find the defendant Howard K. Stern conspired to commit the crime of unlawfully giving a false name in a prescription for a controlled substance in violation of Health and Safety Code 11174.

Stern is asking Superior Court Judge Robert Perry to drop the charges against him. Perry is already under fire from his conduct in the murder trial of Johannes Mehserle, a former transit officer charged with the killing of Oscar Grant. The Department of Justice announced it would be looking into the Oscar Grant case to see if there were civil rights violations.

Perry also displayed inappropriate conduct in the drug trial of Stern, Smith’s doctor Sandeep Kapoor and her so called psychiatrist friend Khristine Eroshevich who at the end of Smith’s life prescribed thousands of pills with Smith reportedly sleeping for days in her own urine, feces and vomit.

According to press reports, Perry was so cozy with the defense in the trial about efforts to procure drugs that eventually ended up killing Smith, that the three defendants confident of acquittal, only called one witness. Perry disallowed crucial evidence, berated prosecutors and according to witnesses, joked around with the defense during breaks. Perry also reported that he was told to “trust the jury” by a respected judge friend, providing even more evidence that Perry appeared to have personal interest in the outcome of the trial and sought to circumvent the jury process.

No further word from Florida as to whether they will pursue murder charges against Stern or Eroshevich. Florida law says people can be charged with first-degree murder if they illegally provide a drug that ends up killing someone. Another possible charge could be manslaughter by culpable negligence.
