The Utah Court of Appeals on Thursday upheld a Springville man’s ninth drunken driving conviction. Robert Van Dyke, who killed a woman in a prior DUI crash, had appealed his April 2008 conviction for DUI, arguing that the officer who stopped him lacked the requisite cause to do so. Van Dyke also claimed the judge in his case allowed prosecutors to present evidence against him that violated the Fifth Amendment’s protection against self-incrimination. A man with nine DUI convictions, including one fatal accident, is appealing the latest jury verdict because he says the arresting officer did not have reasonable suspicion to pull him over. Robert Van Dyke is currently serving a five-year prison term for this case, has been denied parole and is scheduled to be released in 2012. Van Dyke’s defense attorney, Sheldon Carter, told the Utah Court of Appeals on Tuesday that the police erred in stopping Van Dyke because there was no basis for any reasonable suspicion that Van Dyke was driving drunk. Can't blame a girl for trying. Ashley Van Dyke, known (by the very few that know her) as the host of "Speed TV," was busted in Hollywood for DUI last night. After the officer pulled her out of the car, the gearhead gal offered up this defense: "But I'm a race car driver!" It should be noted that Van Dyke was telling the truth: she has driven race cars before, even placing in the top 10 during the 2006 Bullrun race.
