Attorneys for Montana have filed a lawsuit against BNSF Railway Company, accusing it of failing to live up to a 1984 agreement that the state says requires the company to pay some grain shipping costs in central Montana. Montana Attorney General Steve Bullock filed the suit on Nov. 10 in Fergus County, saying BNSF was in effect seeking to create a monopoly in central Montana. The suit asks a state judge to force BNSF to resume the payments and also cover any damages. FORT WORTH, TX - BNSF Railway Company (BNSF) announced yesterday that it will extend its mileage-based fuel surcharge program to carload (Agricultural Products, Coal, Industrial Products and Automotive) customers who do not currently pay a mileage-based fuel surcharge beginning Jan. 15, 2009, and to intermodal customers beginning Feb. 18, 2009. Changes for carload customers will be phased in as current pricing authorities expire. I took this photo after work one evening, in March of 2007. Seen here passing through the crosstracks at Hayford Junction, is a westbound BNSF Railway intermodal container train. This train is traveling over the Belt Railway of Chicago tracks enroute to BRC's nearby Clearing Yard facility in southwest suburban Bedford Park Illinois. Hayford Junction is located at West 75th Street and South Central Park Avenue in Chicago's Ashburn neighborhood.
