In the case of Standardized Field Sobriety Testing, officers are trained to look for established “scoring factors” which must be evaluated in determining whether or not intoxication exists. A finding of intoxication can only arise once sufficient scoring factors are identified. Upon the identification of only a single scoring factor, an evaluation would be required of a high degree of probability of non-intoxication.
