HOUSTON - Roger Clemens has filed an appeal of his dismissed defamation suit against Brian McNamee. Clemens filed a notice Friday with the 5th U.S. Circuit Court of Appeals to review the decisions of U.S. District Judge Keith P. Ellison, who threw out most of Clemens’ case in February and dismissed the remainder of the suit Aug. 28.

The latest move by Clemens lawyer to directly question the immunity of Brian McNamee from libel suit is seen as a desperate tactics by McNamee’s lawyer. The judge holding the case previously dismissed the defamation suit filed by Roger Clemens against his former trainer now the accuser. The immunity was based on the fact that McNamee’s statements were part of a federal investigation. The Daily News is reporting that a former gym owner in the Houston area has been issued a subpoena by the Washington grand jury investigating whether Roger Clemens lied to Congress about using performance-enhancing drugs. The newspaper, in a story posted on its Web site that cited unidentified sources, reported Kelly Blair received on Monday the subpoena ordering him to appear before the grand jury.
