Shepard Fairey has a new legal team and new questions he must answer. The street artist known for his Barack Obama "HOPE" image will be permitted to switch attorneys in his copyright fight against The Associated Press, a federal judge ruled Tuesday. Fairey's previous lawyers had sought to withdraw from the case after Fairey said he had erred about which AP photo he used as the basis for "HOPE" and then tried to destroy evidence of his mistake. The AP had asked U.S. District Judge Alvin K. Hellerstein to deny the switch, saying that Fairey's attorneys had "unique knowledge" about Fairey's actions and that ... Read Full Story

The Associated Press has asked a judge to deny a request by the attorneys of street artist Shepard Fairey to withdraw from his copyright battle over the Barack Obama "HOPE" poster. November 6th, 2009 Random Fairey news: Doing his best James Frey , Shepard Fairey recently reversed his previous position on the reference photo used for his Obama-HOPE poster. Fairey now admits to providing false sources, deleting evidence and says it was indeed the Mannie Garcia photograph (as the AP has alleged all along) that was used in creating the poster. While the exact identity of the photo was so vehemently contested, it also distracts from the essence of the case between Fairey and the AP – the right to fair use and artistic freedoms. Still, the fact Fairey went to such great lengths to ... Read Full Story

Shepard Fairey's claim that he had the right to use a news photo to create his famous Barack Obama "HOPE" poster became a widely watched court case about fair use that now appears to have nearly collapsed. By Friday night, his attorneys — led by Anthony Falzone, executive director of the Fair Use Project at Stanford University — said they intend to withdraw from the case and said the artist had misled them by fabricating information and destroying other material. Fairey himself admitted that he didn't use The Associated Press photo of Obama seated next to actor George Clooney he originally said his work ... Read Full Story
