A British Virgin Islands judge has ruled that a Rhode Island man must serve at least 25 years for killing his wife while diving in the Caribbean in 1999. David Swain faced a mandatory sentence of life in prison following his murder conviction last month. The defense asked that the 53-year-old be eligible for parole after 18 years. But the judge sided with the prosecutor and sentenced him to at least 25 years in Her Majesty's Prison at Balsam Ghut on the island of Tortola. Local authorities initially found no evidence of a crime after Shelley Tyre died while scuba diving. But Swain was ... Read Full Story

A Rhode Island man accused of drowning his wife may depleted her inheritance and courted another woman, his defense lawyer said in closing arguments, but the 1999 scuba diving death was a tragic accident. Testimony ended Monday in the trial of former dive shop owner David Swain. Prosecutors allege Shelly Tyre's death on a diving excursion in this wealthy British Caribbean territory was a nearly perfect murder. Defense lawyer Hayden St. Clair-Douglas urged the jury of seven women and two men to discard any feelings of "dislike" they may have for the 53-year-old Swain, who sat expressionless. "Mr. Swain is not charged with adultery ... Read Full Story

A Rhode Island man accused of killing his wife during a 1999 scuba diving trip testified Thursday that he spent part of her inheritance on courting another woman and taking her on a cruise. David Swain's testimony came during a heated exchange with prosecutors, who accuse him of drowning Shelley Tyre during a vacation in the British Virgin Islands so that he could pursue another woman. Swain denies the charge, but said he vacationed with Mary Basler after Tyre's death, and that they split travel costs. He said he also took two other trips with Tyre's money. A forensic accountant has estimated the inheritance ... Read Full Story

A Rhode Island man accused of killing his wife during a scuba dive was near her when she died, an expert testified Thursday, despite the defendant's claim that the two went their separates ways underwater. Dr. Tom Neuman, an expert in diving deaths, said medical reports indicate that Shelley Tyre stopped breathing at a point in the dive when her husband, David Swain, could still have been nearby. Swain said he and his wife descended together and headed toward a wreck site off the British Virgin Islands and then parted ways. Swain later surfaced without his wife, and another diver found her body. Neuman ... Read Full Story
