Free Criminal Background Checks - ARKANSAS’ NEW LAW ALLOWS THIRD PARTY AND SERVICE PROVIDER ACCESS TO GOVERNMENT CRIMINAL RECORDS

For the first time third parties and service providers have now been granted full access to the Arkansas State Police Online Criminal Background Checks System. But only with the consent of the person who is the subject of the online criminal history report. So in other words, you can not access the reports in Arkansas without the knowledge and approval of the partie being researched. Duh. What a lame law… It is not meant for snooking around neighbours rather than being a source of due dilligence for employeers and land lords for instance. This allows Free Criminal Background Checks but not the way we are used to and certainly not the way we like it.

Before this new law passed, State Law only gave very limited access to the system for professional licensing boards and employers. With the new legislation the Arkansas State Police ”may release criminal history information to agents of employers or persons with written consent of the person who is the subject of the record”.

With this new law staffing agencies, landlords and property owners, financial institutions, background checkers and investigators, law firms etc can run criminal background checks on individuals with the persons written consent. The good news is that the new online system offers instant results compared to the older paper process which often took several weeks.
