We all remember the 2004 Super Bowl halftime show that left viewers scratching their heads wondering, "Did I just see Janet Jackson's boob?"

Well, the answer was yes, and that moment will live on in history as the most well-known celebrity wardrobe malfunction. 90 million people had tuned in for the Super Bowl, and as a result, the Federal Communications Commission (FCC) imposed a $500,000 fine on CBS for airing the "indecent exposure."

But today that fine was overturned by the 3rd U.S. Circuit Court of Appeals, after three judges ruled that the FCC "acted arbitrarily and capriciously in issuing the fine for the unplanned nudity.

In other words, CBS does not have to pay the fine for showing the world Jackson's boob. The decision is only fair, especially considering the fact that celebrity wardrobe malfunctions are pretty common place now.

One week Britney Spears isn't wearing underwear, and the next week, it's Lindsay Lohan. Indecent exposure is not an unknown word in Hollywood, and luckily for us, there are cameras there to catch every single wardrobe malfunction imaginable.

While attending the premiere of Where Truth Lies, the strap of her dress slipped, exposing her entire left breast. Unlike Tara Reid, Marceau quickly caught the mistake, but not quick enough.

Maybe it's because she's crazy, or because she really just does not like to wear clothes, but Britney Spears has a lot of wardrobe malfunctions. At this point, many of them are questionable (does it really count as a malfunction if you just forget to wear pants?) but for sure, Spears needs to learn to either get out of a car correctly, or wear underwear.

A US appeals court has thrown out the $550,000 fine levied again CBS Corp. television stations for the 2004 Super Bowl halftime show that ended with Janet Jackson [ tickets ] flashing her breast for a fraction of a second.

The US Court of Appeals for the Third Circuit said the Federal Communications Commission "arbitrarily and capriciously departed from its prior policy" that exempted fleeting broadcast material from actionable indecency violations, according to Reuters.

Nearly 90 million viewers were tuned in when Justin Timberlake ripped off part of Jackson's bustier while singing the lyrics "gonna have you naked by the end of this song." Both performers claimed the flash was an accident, with Timberlake coining the term "wardrobe malfunction."Read more....

It's been four long years since America was rocked to its core by the controversy known as 'Nipplegate.' While Janet Jackson was publicly flogged for the "wardrobe malfunction," Justin Timberlake emerged relatively unscathed, blaming it all on Janet. CBS was fined $550,000 by the FCC for the incident, because Lord knows, children were watching. Think of the children! Today marked the final chapter in the saga, when an appeals court threw out the FCC's claim that the 2004 Super Bowl halftime show was incident, ordering that CBS was not responsible for paying the $550,000 fine. Today the Federal Appeals Court dismissed a $550,000 indecency fine against CBS. The fine was slated by the FCC when a wardrobe malfunction exposed Janet Jackson’s breast at the halftime show of the 2004 Superbowl.

Jackson was performing with Justin Timberlake when he made a move that exposed her right breast to over 90 million viewers. The pair denied that the stunt was staged and said it was accidental.

The 3rd U.S. Circuit Court of Appeals said the FCC “acted arbitrarily and capriciously” when it issued the pricey penalty against the CBS for the “exposure” and tossed the case out of court.

The three judge panel said that the FCC has overreacted and ignored their 30 year practice of fining for programming deemed to be indecent in order to shock the audience.

That decision saved CBS quite a bit of cash. They, along with the FCC, Justin Timberlake and Janet Jackson weren’t available for comment.
