Charlie Sheen Has Lost Custody Battle to ex Brooke Mueller

Two wrongs don't make a right. When Charlie Sheen's estranged wife Brooke Mueller refused to take a drug test and re-entered rehab last week, he saw it as a golden opportunity to try to score custody of their kids.

But the Los Angeles judge isn't having any of it; he fizzled Sheen's fantasy by rejecting his plea to win primary legal and physical custody over the former couple's little ones, Bob and Max.

Brooke nor Charlie sound fit to be fighting for child custody when they are both having trouble taking care of themselves. In the courtroom, Broke was reportedly "unsteady on her feet" and "glassy-eyed." And Sheen, who has recently crusaded on his country-wide Violent Torpedo of Truth/Defeat is Not an Option comedy tour, was at an uncharacteristic loss of words. He simply stated: "No comment."

For now, while Brooke is battling her cocaine addiction in rehab and Sheen is performing garbled sentences onstage, Brooke's socialite mother Moira Fiore will be watching the boys.
