Awareness of retailer eligibility schemes and independent age verification and purchasing restrictions
A few retailers have third-party eligibility-verification programs to verify whether adults are eligible for specific offers. One such platform is GOVX, which caters to veterans, military members and other qualified communities of public service.
Participating online retailers Nicokick.com and Northerner.com state that eligible GOVX members aged 21 and older who currently use tobacco or nicotine products may qualify for a 10% discount, subject to the retailers’ published terms and applicable law.
The offer is subject to retailer conditions and applicable state and local restrictions. Availability may vary by jurisdiction and should not be interpreted as nationwide authorization for discounted nicotine product sales.
Membership Benefits Do Not Override Purchase Restrictions
The eligibility to buy nicotine products is not the same as the legal authorization to buy nicotine products.
An individual’s eligibility to an offer is determined by the eligibility requirements of the program. GOVX verifies this. Retailers individually, are responsible for verifying that a customer meets the age, identity and purchasing criteria.
The federal minimum age for the sale of tobacco products in the U.S. is 21 years. Nicotine products may be subject to other laws or ordinances that are state or local in nature, which may limit the sale, distribution, shipping and discounting of nicotine products.
Therefore, it is not a criterion of GOVX membership whether a specific purchase and/or discount of nicotine pouches is allowed in a customer’s location.
FDA Status Is Specific to Individual Products
Regulatory status is another consideration separate from discount eligibility.
The FDA evaluates nicotine pouch products individually. Marketing authorization for one product does not extend automatically to other products, flavors or nicotine strengths.
FDA authorization also should not be described as FDA approval or as a finding that nicotine pouches are safe. Any authorized modified-risk statements are limited to the particular products and claims identified in the agency’s orders.
Those distinctions remain relevant regardless of how a customer qualifies for a retailer’s discount.
How These Requirements Apply Online
If online transactions, age and identity verification, product availability and delivery restrictions must be considered, they should be done separately from the eligibility to GOVX.
Retailers might have to impose further restrictions as per the final destinations of the orders such as shipping restrictions and adult-signature delivery, depending on the law.
This means that even if the legislation or purchase at the state and/or local level allows a retailer a discount, the retailer itself may not be able to take advantage of it if the member has been verified.
Eligibility Does Not Replace Purchasing Requirements
Eligibility verification is the process of checking if the buyer is eligible for a retailer offer. It makes no judgment on whether a purchase of a nicotine pouch is allowed.
Federal, state and local laws, and the terms and transaction controls of the retailer, continue to regulate the legal right to acquire a nicotine product.

The information and advertising purposes of this article are designed solely for informational purposes. It makes no claim that nicotine pouches are safe, safer than cigarettes or other tobacco products or effective for quitting smoking. Any claim of a reduced risk or modification of a reduction in risk would need the U.S. Food and Drug Administration’s individual approval for that specific product.
Nicotine is addictive and meant for adults who already use tobacco or nicotine and are at least 21 years old to purchase it. If an adult is thinking of modifying their tobacco or nicotine use they should talk with a health care provider.
