A judge says the New York State Athletic Commission failed to properly weigh boxer Arturo Gatti before a Madison Square Garden bout in 2000 but rejects ex-fighter Joey Gamache's claim it caused his career-ending knockout loss.
Court of Claims Judge Melvin Schweitzer says evidence shows commission official Anthony Russo let Gatti off the scale before it could be reasonably determined he made the 141-pound limit but doesn't show Gatti was "substantially" heavier.
HBO unofficially weighed Gatti at 160 and Gamache at 145.
Gamache says he suffered brain damage in the fight.
Russo said in a deposition he couldn't recall if he or the commission's chairman conducted the weigh-in. Russo has since died.
A commission spokesman hasn't returned a phone message left Thursday.
Gatti was found dead under mysterious circumstances at a Brazilian resort last July, before the trial.
