MARTINSBURG - A Martinsburg woman arrested last year for allegedly tying a dog's mouth shut with duct tape to stop it from barking, and who witnesses allege left the animal tied up in a basement without food or water for three weeks, won't be prosecuted for felony animal cruelty because prosecutors say the evidence in the case doesn't meet the definition of torture under state statute.
